1. Acceptance of Terms

These Terms of Use (“Terms”) constitute a legally binding agreement between you and Santanero Media Group, LLC (“Santanero Media Group,” “we,” “us,” or “our”) governing your access to and use of our websites, newsletters, radio streams, podcasts, social media accounts, and related services (collectively, the “Services”).

By accessing, browsing, subscribing to, interacting with, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you should discontinue use of the Services.

2. Changes to the Terms

We may update, revise, modify, or replace these Terms from time to time.

When changes are made, we will post the updated version and revise the Effective Date above. Continued use of the Services after revised Terms are posted constitutes acceptance of the updated Terms.

3. Description of Services

Santanero Media Group provides media, publishing, and communications services, including but not limited to:

  • Digital journalism and news reporting
  • Newsletters and email communications
  • KSNG-DB “Santanero Radio” programming and audio streams
  • Podcasts and audio content
  • Community calendars and event listings
  • Opinion and commentary content
  • Advertising and sponsorship opportunities
  • Social media content
  • Other current or future media services

We may modify, suspend, discontinue, restrict, or remove any portion of the Services at any time without notice.

4. Eligibility

You agree to use the Services in compliance with all applicable laws and regulations.

By using the Services, you represent and warrant that:

  • You have the legal capacity to enter into this agreement;
  • Your use of the Services will comply with applicable law; and
  • Any information you provide to us is accurate and not misleading.

5. Intellectual Property and Content Use

Unless otherwise stated, all content available through the Services, including but not limited to articles, news reports, audio programming, podcasts, photographs, graphics, logos, trademarks, branding, website design, text, databases and compilations is owned by or licensed to Santanero Media Group, LLC and is protected by applicable copyright, trademark, and other intellectual property laws.

You may access and use content solely for personal, non-commercial purposes.

Except as permitted by law or with prior written permission, you may not copy, reproduce, republish, redistribute, modify, create derivative works from, sell, license or exploit our content.

You also agree not to scrape, harvest, extract, reproduce, download, archive, or use our content for the purpose of training artificial intelligence systems, machine learning models, datasets, automated content-generation systems, or similar technologies without our prior written authorization.

6. User Conduct

You agree not to:

  • Violate applicable laws or regulations;
  • Interfere with the operation of the Services;
  • Attempt unauthorized access to systems, networks, accounts, or data;
  • Circumvent security measures;
  • Transmit malicious software or code;
  • Impersonate another person or entity;
  • Submit false, misleading, or deceptive information;
  • Engage in automated scraping, harvesting, or data extraction activities;
  • Use the Services in a manner that disrupts other users.

We reserve the right to restrict, suspend, or terminate access to the Services for violations of these Terms.

7. Community Contributions and User Submissions

Certain portions of the Services may permit community submissions, including opinion pieces, event announcements, photographs, letters, news tips, or other contributed materials.

Such submissions are governed by our Community Contributions Policy.

Submission of content does not guarantee publication, review, response, or future coverage.

We reserve the right to edit, reject, remove, archive, or decline any submitted material at our discretion.

8. Advertising and Sponsored Content

The Services may include advertising, sponsorships, underwriting acknowledgments, promotional materials, or sponsored content.

Advertising and sponsored content may be identified through labels, disclosures, sponsor acknowledgments, or similar notices when appropriate.

The presence of advertising does not constitute endorsement by Santanero Media Group, LLC.

We are not responsible for the accuracy, legality, reliability, or quality of products, services, organizations, or claims made by advertisers.

Advertisers do not control editorial decisions, newsroom coverage, corrections, publication decisions, or editorial judgment.

The Services may contain links to third-party websites, applications, services, or resources.

We do not own or control those third parties and are not responsible for content, privacy practices, availability, security, actions or omissions.

Access to third-party services is at your own risk.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SANTANERO MEDIA GROUP DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR RELIABILITY.

WE DO NOT GUARANTEE THAT:

  • THE SERVICES WILL BE UNINTERRUPTED;
  • THE SERVICES WILL BE ERROR-FREE;
  • THE SERVICES WILL BE SECURE;
  • CONTENT WILL ALWAYS BE COMPLETE OR CURRENT;
  • DEFECTS WILL BE CORRECTED.

YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SANTANERO MEDIA GROUP, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, REVENUE, BUSINESS OPPORTUNITIES, OR OTHER INTANGIBLE LOSSES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

THIS LIMITATION APPLIES REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

12. Indemnification

You agree to indemnify, defend, and hold harmless Santanero Media Group, LLC, its owners, officers, managers, employees, volunteers, contractors, affiliates, and representatives from and against any claims, liabilities, damages, losses, expenses, costs, or legal fees arising out of:

  • Your use of the Services;
  • Your violation of these Terms;
  • Your violation of applicable law;
  • Your infringement of the rights of another person or entity.

13. Termination

We may suspend, restrict, terminate, or discontinue your access to the Services at any time, for any reason, or for no stated reason, with or without notice.

Termination shall not affect any rights, obligations, disclaimers, limitations, or protections that by their nature survive termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.

15. Venue and Jurisdiction

Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Orange County, California.

By using the Services, you consent to the jurisdiction and venue of those courts.

16. Relationship to Other Policies

Additional terms, policies, and guidelines may apply to specific activities, submissions, purchases, or services.

In the event of a conflict between these Terms and a policy specifically governing a particular activity or transaction, the more specific policy shall control.
