Santanero Media Group, LLC. d.b.a. Santanero Media Group, LLC, The Santanero and KSNG-DB “Santanero Radio”

1. Overview

These Terms of Sale ("Terms") govern purchases made through Santanero Media Group, LLC ("Santanero Media Group," "we," "our," or "us"), including purchases of merchandise, advertising, sponsorships, promotional services, event-related offerings, subscriptions, and other products or services that may be offered through our websites, newsletters, publications, broadcasts, social media platforms, or related services (collectively, the "Services").

By placing an order, purchasing a product, reserving advertising space, purchasing sponsorships, or otherwise engaging in a transaction with us, you agree to these Terms of Sale.

These Terms supplement our Terms of Use.


2. Products and Services

We may offer products and services including, but not limited to:

  • Apparel
  • Tote bags
  • Branded merchandise
  • Event-related merchandise
  • Advertising placements
  • Newsletter sponsorships
  • Digital sponsorships
  • Promotional services
  • Community partnership opportunities
  • Other products or services

Availability of products and services may change without notice.

We reserve the right to modify, discontinue, limit, or refuse any product or service at our discretion.


3. Pricing

All prices are listed in U.S. dollars unless otherwise stated.

Prices, fees, advertising rates, sponsorship rates, and other charges may be modified at any time without notice.

We reserve the right to correct pricing errors, typographical mistakes, technical errors, or inaccuracies.

If a pricing error affects an order already placed, we may cancel the affected transaction and issue an appropriate refund.


4. Taxes

Applicable taxes may be added to purchases where required by law.

Customers are responsible for any taxes, duties, fees, or governmental charges associated with a purchase unless otherwise stated.


5. Orders and Acceptance

Submission of an order, advertising request, sponsorship reservation, or purchase request does not guarantee acceptance.

We reserve the right to:

  • Reject orders;
  • Reject advertising purchases;
  • Reject sponsorship requests;
  • Limit quantities;
  • Refuse service;
  • Cancel transactions;
  • Request additional information.

A transaction is considered accepted only after we confirm the purchase or begin fulfillment.


6. Payment

Payment must be made using approved payment methods.

We may utilize third-party payment processors to facilitate transactions.

By submitting payment information, you represent that:

  • You are authorized to use the payment method;
  • The information provided is accurate;
  • The transaction is lawful.

We do not store complete payment card information.

Payment processing remains subject to the terms of the applicable payment provider.


7. Merchandise Fulfillment

Certain merchandise may be manufactured, fulfilled, packaged, or shipped by third-party fulfillment providers on behalf of Santanero Media Group, LLC.

By purchasing merchandise, you acknowledge that production, fulfillment, and delivery may be performed by independent vendors, print-on-demand providers, shipping carriers, or other service providers.

Estimated processing and delivery times are provided for informational purposes only and are not guaranteed.

We are not responsible for delays caused by:

  • Fulfillment providers;
  • Shipping carriers;
  • Supply chain disruptions;
  • Inventory shortages;
  • Weather conditions;
  • Labor disputes;
  • Technical failures; or
  • Circumstances beyond our reasonable control.

Product colors, materials, sizing, printing, packaging, and appearance may vary slightly from images displayed online.

We reserve the right to change fulfillment providers, manufacturing methods, shipping methods, or product specifications without notice.


8. Advertising and Sponsorship Purchases

Advertising and sponsorship purchases are subject to our Advertising Guidelines and applicable editorial policies.

Acceptance of payment does not guarantee publication, placement, scheduling, distribution, or continued display of advertising content.

Advertising materials may be rejected, suspended, modified, delayed, or removed if they:

  • Violate our policies;
  • Violate applicable law;
  • Contain misleading information;
  • Conflict with our editorial standards;
  • Become factually inaccurate.

Advertising purchases do not influence editorial decisions, news coverage, corrections, publication decisions, or editorial judgment.


9. Advertiser Responsibility

Advertisers and sponsors are solely responsible for ensuring submitted materials:

  • Are accurate;
  • Are lawful;
  • Do not infringe intellectual property rights;
  • Comply with applicable regulations;
  • Do not contain false or misleading claims.

Advertisers may be required to provide documentation supporting claims made in advertisements. More information can be found in our Advertisement Guidelines.


10. Returns and Refunds

Merchandise

If a merchandise order arrives damaged, defective, misprinted, or materially different from the item ordered, customers should contact us within fourteen (14) days of delivery.

Resolution of merchandise issues may require coordination with third-party fulfillment providers, manufacturers, or shipping carriers. We may request photographs, proof of purchase, or additional information before determining an appropriate resolution.

We may request:

  • Proof of purchase;
  • Photographs;
  • Additional information.

Depending on the circumstances, we may provide:

  • A replacement;
  • A refund;
  • Store credit;
  • Another reasonable resolution.

Unless otherwise stated, returns based solely on preference, sizing issues, or minor product variations may not be accepted.

Advertising and Sponsorship Purchases

Advertising, sponsorship, promotional, and service purchases are generally non-refundable once services have been confirmed to be scheduled, published, delivered, distributed, or performed.

Refund requests may be reviewed on a case-by-case basis.

Lost or Delayed Shipments

If a merchandise shipment is lost in transit or experiences significant delivery issues, we may, at our discretion and subject to verification with the carrier, provide a replacement, refund, store credit, or other appropriate resolution.

Refund Requests and Order Support

Customers seeking assistance with an order, return, replacement, refund request, shipping issue, fulfillment concern, or other purchase-related matter should contact our sales team as soon as possible.

Requests should include:

  • The purchaser's name;
  • Order number, if available;
  • A description of the issue;
  • Photographs or supporting documentation, when applicable; and
  • Contact information for follow-up.

Submission of a refund or support request does not guarantee approval of a refund, replacement, or other resolution. Each request will be reviewed based on the circumstances, available documentation, applicable policies, and information provided by fulfillment partners, shipping carriers, or service providers where applicable.


11. Intellectual Property

All product designs, logos, branding, trademarks, advertising materials, publications, and related content remain the property of Santanero Media Group, LLC or their respective owners.

Purchase of a product or service does not transfer ownership of intellectual property rights.

Customers may not reproduce, distribute, resell, or commercially exploit our intellectual property without authorization.


12. Prohibited Uses

Customers may not use our products or services to:

  • Violate applicable law;
  • Misrepresent our organization;
  • Facilitate fraud or deception;
  • Infringe intellectual property rights;
  • Interfere with our operations.

We reserve the right to terminate transactions or refuse future business relationships where appropriate.


13. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRODUCTS AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR PERFORMANCE, EXCEPT AS REQUIRED BY APPLICABLE LAW.


14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SANTANERO MEDIA GROUP, LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO ANY PURCHASE OR TRANSACTION.

OUR TOTAL LIABILITY ARISING FROM ANY PURCHASE SHALL NOT EXCEED THE AMOUNT PAID FOR THE APPLICABLE PRODUCT OR SERVICE.

Nothing in these Terms shall exclude or limit rights that cannot be excluded under applicable law.


15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-law principles.


16. Venue and Jurisdiction

Any dispute arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Orange County, California.

By entering into a transaction with us, you consent to the jurisdiction and venue of those courts.


17. Changes to These Terms

We may update, revise, modify, or replace these Terms from time to time.

When changes are made, we will revise the Effective Date above.

Continued purchases or use of paid products and services after updated Terms are posted constitutes acceptance of the revised Terms.


18. Relationship to Other Policies

These Terms should be read together with our other policies published by Santanero Media Group, LLC.

If a conflict exists between these Terms and a policy governing a specific product or service, the more specific policy shall control.
